Divorce and child custody. Please tell me how to proceed ?

I found that my husband goes out to drink daily after office and tells me that he goes for meetings. When I found this through his credit card bills, he has stopped talking and in no mood to discuss anything. I have 2 kids and he keeps saying that we should not be wasting money but he secretly was doing this. I don't see a future with him. What can be done?

According to Hindu Hindu Marriage Act and special Marriage act legal grounds for divorce petition are under following heads
1.Cruelty: under this heads cruelty includes physical cruelty mental cruelty and financial cruelty
2. Desertion: when other husband or wife living separately for more than 2 years it comes under desertion on that ground you can raise divorce petition in the Civil Court.
3. bigamy and adultery: when one of the partner commits crime under this heads divorce petition can b raise on this grounds.

You have stated your issue that your husband is wasting money on his addiction to prove any cruelty against him is not possible in this case you should file case for maintenance of your children and for yourself

In this case you can you can get counseling from a family law practitioner.

If the issue between you and your husband does not resolve then the matter may be referred to court for the further legal proceedings
