Divorce after 5 months of marriage possible

Hi I was planning to marry a grl in dec’15 but my past grlfrn filled a FIR against me for false commitment of marriage due to physical relations. Due to this my marriage broken and forcefully I got married with my grlfrn (who is alresdy married before 14 yrs but not got divorce from her husband). Now our case got quashed in HC but I don’t want to live with her anymore. I am trying to convince her to go for mutual consent divorce. What is the best way to get the divorce asap.. please suggest, I am in very much of mental harassment.

If she was not divorced at time you got married to her then you can go and file divorce not itself as your marriage with her is void ab initio.
In a void marriage , the parties do not acquire any status of husband and wife as such it does not confer any mutual rights and obligations upon the parties .

I would advise you to get a divorce as soon as possible. You can get that done easily. All that you need to do is to file a petition. Even if it is converted into a case of mutual divorce. It seems that these circumstances are quite exceptional.

Mutual consent divorce is the the most immediate manner of divorce but it also have a cooling off period of six month from first motion and last motion. If mutually decided between the parties you do not have to go to mediation and can have divorce within. 6 months
