Divorce after 3 years of marriage husband staying abroad

07-Mar-2023 (In Divorce Law)

I want to file for a divorce from my husband. We don't get along at all. We have been living apart for a year- he lives abroad and we have met twice during the last 11 months. I want to know how long will this process take and will he need to be physically present during court hearings or could he join in via video call and sign the papers sent to him? He's coming to India at the end of April and will return within a week. Also how much will this whole process cost- lawyers fees, and other document filing? Could you give an estimate please? Thanks.

Firstly madam you have specified you want to seek divorce, is it by mutual consent of both, or you shall file case on ground of cruelty and desertion etc. For process of mutual consent firstly one year of marriage should be completed, and further atleast six months period will be required. Both parties are required to be present at the time of filing the case and leading evidence mostly with close relatives evidences.
so far filing divorce on ground of desertion and cruelty is concern you can file the same for which you have to prove the allegations.
Video call can be possible in this case. the process requires depending on how it goes may be at least 2 years.
And finally as far as fees structure is concerned see gravity of matter the same shall be decided after you contact the lawyers whom you choice.

Dear client if both want to file divorce then u can file mutual divorce and will get divorce in six months. U both have to remain present in court for two times personally. If he is not ready for divorce then u have to file contested divorce on the grounds like desertion cruelty against him. If he will not remain present in court after service of summons then court will give u ex party.divorce. every lawyer charges his own fees so charges varies from lawyer to lawyer.
