Dismissed Interim application by Father for Child visitation
Dismissed Interim application by Father for Child visitation
14-Oct-2024 (In Divorce Law)
Custody for son is going on. Father has interim visitation for 2/4 Saturday. Father has filed application for 5 day winter vacation. Session court dismissed application after interrogation of child and provided response by Mother. Father has warned of reaching out to hight court for this application.
What are the possibilities available to father to turn this around if he reaches to highly court
In response to the query:
If the father plans to approach the High Court after the Sessions Court dismissed his application for a 5-day winter vacation visitation, the following possibilities are available to him:
1. Filing a Revision Petition or Appeal: The father can file a revision or appeal in the High Court against the Sessions Court’s order, arguing that the dismissal was not justified and that he deserves more time with his child, especially during the winter vacation. He can present his case focusing on the welfare of the child and his rights as a parent.
2. Welfare of the Child Argument: The father must demonstrate that the extended visitation is in the best interest of the child, emphasizing the importance of a healthy relationship between the child and both parents. If the Sessions Court's decision was based on an interrogation of the child, the father should focus on challenging any inconsistencies or emphasizing emotional bonding between the father and the child.
3. Urgency and Special Circumstances: The father can request the High Court to consider the specific context of the case and present any special circumstances that may warrant granting the 5-day vacation visitation. For example, if this is a rare opportunity for quality bonding time with the child, the court might be more inclined to grant the request.
4. High Court’s Discretion: The High Court has the discretion to modify or overturn the Sessions Court’s order if it believes that the earlier decision was not in the child's best interest or that the father has a valid case. However, the court will still prioritize the child’s welfare and will consider the mother’s objections, along with the child’s preferences (if the child is mature enough to express them).
To increase the chances of success, the father’s application must be well-supported by arguments focusing on the child's emotional needs and the father’s positive involvement in the child’s life.
