Dasti Service in Exparte Divorce

In Dasti Service in Exparte order : 1] Is it mandatory to affix a copy of the process at the ordinary residence or place of business of the defendant at the when she has refused to take the summon (Lene se inkar kiya) 2] Incase the wife has refused to take the summon (Lene se inkar kiya) and she has been identified by husband and process server of court during dasti service and the court server gives undertaking on Dasti order about the same.

Yes, if the respondent/defendant refused to take summons and the process server gave his report about the refusal of the same then the court do ex-parte to the respondent/defendant. You can discuss your case with me through phone or meeting.

Respected sir Once it has been noted down by the process server that your wife has refused to accept the court notice, it is presumed that the said notice is served upon her. Refusal=acceptance. You may reach out to me for further clarification though.
