06-Oct-2023 (In Divorce Law)

I have filed my first motion for mutual divorce but i got a date for second motion for almost after 11 months so how can i actually reduce it to normal 6 months or even lesser if possible. And how is it that court gave a date for so late?

In case the first motion has been granted, the court ought to have given a date after 6 months which is also know as the cooling period. In case the same has not been done by the court, u can move an application for early hearing. In case the court is not willing to accept your request, u can challenge that order in the High Court.

Some district courts are extremely lax and do not follow the required procedure. File a revision or appeal to the order that has given you such a long date. You could also file an application for early hearing.

The Supreme Court of our country has ruled that if there is no scope for reconciliation between the parties then should not be made to wait even for six months. Hope this helps.
