Contempt petition filed in Family Court

30-Jul-2023 (In Divorce Law)
My daughter is a Hindu wife, separated and living in my house with her 3 old son. Her husband filed petition for child visitation in family court. Order issued for physical visitation once in a month at the court premises. Accordingly child was taken to the court premises. Her husband absent for visitation but wanted to see the child through video only. She did not responded for video calling. Now he filed contempt petition in the Family Court U/S 12 of the Contempt of Court Act, 1971. Judge handed over the copy of the petition and asked to reply within one week. 1. Can contempt petition be filed in Family Court? 2. Can Judge demand reply within one week.

Contempt jurisdiction can be invoked by High Courts and the Supreme Court only. The family court cannot entertain contempt petition directly. You can raise the issue of maintainability of the contempt petition before the family court. The contempt petition must be filed before the high court.
