Contempt case on violation of child visitation

12-Mar-2026 (In Divorce Law)
In A GW Custody case ... I (father) have visitation for meeting my child 8 yrs every 2nd and 4th Saturday for 4 hours... I was allowed to meet for 1 year than more than 1 yr not allowed to meet. Court also allowed summer vacations and birthday stays which was again not allowed by Wife (mother). Every time I go they say child is not willing to meet . I have filled contempt case also ... Do courts give any punishment to wife for such contempt or its only minor financial fine

Hi there, in these cases the cause of action isn't that strong. Generally, they escape using some excuse to disregard the court order. Therefore, in general the court gives a warming and let the matter go without any penalty/fine imposition. If you have any questions feel free to contact me.

Hi, If there is a court order granting visitation rights and the mother is deliberately not complying with it, it amounts to wilful disobedience of the court’s order. Since you have already filed a contempt petition, the court can certainly take action if it finds that the mother is intentionally violating the order.

There is a violation of the rights granted to you and hence that is something which is wrong and warrants legal action. By filing a contempt case, you're making a person accountable for the violation done by them and if the Court deems fit, punishment is awarded to them

Simple Imprisonment – up to 6 months, or Fine – up to ₹2,000, or Both imprisonment and fine So the judge is not limited to only imposing a fine. The court can also order imprisonment if the disobedience is deliberate.

The contempt case filed only constitutes a civil contempt. Though there is a provision for civil imprisonment in case of non compliance of courts orders women cannot be put in a civil prison. therefore the only remedy available before a court is the imposition of a fine. if the mother does not comply with the courts order granting visitation rights to the father, the father may file an execution petition before the family court seeking police assistance for production of the child. this would be a for better remedy than filing of a contempt petition.
