Confused about exact or approx amount of alimony

If wife filed DV case. With false allegations n no domestic n matrimonial relationship for 2 yrs n living separation was 4 yrs just 6 month marriage but wife with one child can demand how legally of husband annual income is 100% she can demand 500% ?? Bacz I have seen many cases 100% to wife n 100% to child ..I also have 1 child n my annual income is 9Lk but wife demanding huge amount 50Lk so what is ur experience veterans what is approx amount if I want to settle outside ? What is expr. Says?

There is no fixed rule that a wife can claim 100%, 500%, or any particular percentage of the husband’s annual income in a DV/maintenance case. The court considers both spouses’ income, child’s needs, standard of living, liabilities, custody, and other circumstances. If your annual income is around ₹9 lakh and there is one child, a ₹50 lakh lump-sum demand is not automatically payable; settlement depends on the complete facts and financial capacity. For an informed settlement figure, first calculate reasonable monthly maintenance + child expenses and negotiate accordingly rather than accepting the ₹50 lakh demand merely because it is claimed.

It will totally depend upon your offer and their acceptance for the settlement of the case, as the alimony is different in each of the individual cases depending upon place, age, net worth there are various factors to it also, you need to be practicing your case really aggressively to settle the case with your wife in minimum amount, also your conduct is also which needs to be taken care of, the one time alimony of 8-9 lakhs should be enough to finish the whole case if they are ready to move on if not you need to settle it at a much higher amount as a child is also involved in this

You will be sent for mediation in the DV case. It can be your best chance to settle it with the mediator's help. Does the one time alimony provide for the child too. She has other options to seek child support. So determine if you have to make continuous payments towards the child in the future too. With the child her bargaining power increase. Start with an offer of 20. settle it in the range of 30.
