Conditions in case of contested divorce when there is criminal charge

my wife has registered a case of dowery against me and I have registered case of divorce in session court narnaul .both of we have no any relations from last two years. can divorce is possible when my wife is not agree?if possible then on which section or act of court please suggest me bcoz I m facing big problems.

Good morning, according to your query you can file a suit against your wife for Divorce in Hindu Marriage act 1955 on behalf of separation or no any relation of any kind between both of you and it will be relevant as an ex-parte Divorce.

You can file a divorce petition on ground of cruelty but in this ground You have to prove cruelty in the court. Other ground of cruelty is also available according to your circumstances if you you have succeeded to prove cruelty than court has early granted divorce. Secondly you can file a petition under section 9 of H M act and after getting order from court you can easily get divorce from court.
