Concern Regarding Child custody issue

Hi, I'm living separately from my husband from last 1.4 years. I have one daughter and her age is 5.9 Years old. As I'm maintaining her all expenses and mine. Even when I was there in his house that time also he was not ready to bear the expenses. He is into property dealing business. We had very heated argument since I left that my in-laws home, he just thrown out of me. But he comes regularly once in a week to meet my daughter not me. & wanted to know Will he get the custody of my daughter?

As per the law, the custody of a minor child, especially below the age of 18, is generally granted to the mother, as she is considered the primary caregiver, unless it is proven that she is unfit. Since you have been maintaining your daughter's expenses and her well-being, and the father has not been contributing financially, it strengthens your case for custody. However, the father has a right to visitation, which he is currently exercising. Courts prioritize the best interests of the child, so unless he can prove that living with you is detrimental to your daughter, he is unlikely to get custody. You can also file for maintenance for your child and yourself if needed.
