Clarification regarding cooling off period

30-Sep-2026 (In Divorce Law)
Me and my wife has filed for mutual divorce in August 2026. On first hearing on September 05, 2026 , we were sent for mediation which got failed where we both stated that we wanted to separate mutually. Now next date is in November. My first motion statement are yet to be recorded. Could you clarify whether cooling period of 6 month is considered from date of filing of petition or from date of recording of statement for first motion as in act it is mentioned from date of presentation of petition.

It’s considered from date of filling and this (Supreme Court Precedent: In Amardeep Singh v. Harveen Kaur (2017) and Shilpa Sailesh v. Varun Sreenivasan (2023), the Supreme Court of India held that the 6-month waiting period is directory, not mandatory ) judgement is very useful to get Divorce in first hearing or before six months .

Om Prakash, (1991) 2 SCC 25)।
