For a minor's passport when parents are divorced, submit Annexure C declaration if the custodial parent (you) applies alone. Select option (c): custody assigned without visitation rights to the other parent, attaching the divorce decree/court order. This avoids needing the father's consent, as no visitation exists as per agreement.

as a father he has full rights to visits his kid under the conditions prescribed under visitation rights. if he meet more than the timing specifically mentioned then there is a problem , or if he tries to damage the psychology of a child or damage the kid anyway, then his visitation rights can be removed.
