Child name change post divorce

22-Aug-2023 (In Divorce Law)
Hi, I am divorced, custody of my son is with me. Father has visitation rights but haven't seen the child from last 4 years. I want to change my son's last name, at present father's last name to my last name before marriage. Is it possible? And want to put only my name is in his passport but passport officer denied. I showed him the all the legal paper. Still they said they will not remove his father's name. I want to apply for Canadian PR and doesn't want to have any issue in my son's case.

Generally this would be very contentious and would entail litigation. However there are ways it can be done. We have done it for our UK based client. It wouldn't have any issue with your son's Canadian PR.

Sir, unless and until you get the legal guardianship of the child by a valid adoption his sir name can't be changed in the documents. The passport officer has guided you correctly. If you need my assistance you may consult me.
