this totally depend on which law you are governed by. the matter he is differet for hindus at it is GOVERNED under HINDU MARRIAGE ACT , HINDU SUCCESSION ACT . HINDU ADOPTION AND MAINTAAINCE.. IN CASE HUSBAND AND WIFE ARE MUSIMS THEN IT IS GOVERNED BY PRINCIPAL OF MUHAMMEDAN LAW.. WHERE custody have different conditions for intercast marriage there you have to file application before cout to declare you as custodian /gaurdian
