Child adoption without the consent of biological father
12-Aug-2023 (In Divorce Law)
My daughter got divorced almost 2 years ago. After divorce she got the custody of her son who is now 5 years old. Now my daughter is going to get married again and her present would be husband wants to adopt her son. But her ex-husband is not ready to give consent for this process. So please advice if there is any way that the adoption process can be completed without informing the ex-husband or his consent.
father has the first right of granting adoption. in few cases this right can be exercised by the mother but those are very limited and I think those are not occasioned in your case. so the adoption cannot take place without the consent of the ex husband. but if few other facts regarding the existing relationship between the biological father and the child can be established then the consent of the biological father can be waived and the mother's consent will be enough. your lawyer can guide you on this aspect.
