Child access/ Visitation rights

When signing mutually - if the mother is taking child out of india temporarily or permanently, does she needs to father permission. father is asking to sign to this on consent terms If i dont want alimony and dont want maintenance, and dont want to to give access too. please advice

Taking the child away from India temporarily or permanently depends on whether the Court has granted custody to you and moreso, whether both of you have agreed upon the same. As far as maintenance of you and your child is concerned, it is no dependent on custody or access of the child. Feel free to contact me for seeking any legal advice as regards the same.

Well, your Husband cannot compel you to sign on the Mutual Divorce Petition to seek Mutual Divorce. If the terms and conditions of the Mutual Divorce Petition are not acceptable to you, you demand from your Husband to change it by instructing his Advocate, to make it flexible, so that, it needs to benefit both parties, not merely Husband.
