My advocate is saying that he would not be able to handle my divorce proceeding any more as he got a better chance in some another city. What should I do?

Under the Bar Council of India Rules (Chapter II, Part VI, Section II – Duties of Advocates to Clients), an advocate can withdraw from a case only after giving reasonable notice to the client and obtaining the court’s permission, if the matter is already pending before a court. He must: Inform you in writing of his decision to withdraw, and Return all case papers, evidence, and documents in his possession, and Refund any unearned portion of the fees, if applicable. Ask your current advocate to: File a Memo of Withdrawal or No Objection Certificate (NOC) before the court. This allows you to appoint a new lawyer formally.

dear client as per your query since your advocate is no longer dealing with your case you need to ask him to provide you no objection certificate (N.O.C ) to you so that you can hire another advocate for your required case..

you can appoint a new Advocate anytime. it is the choice of the litigant to appoint any Ld. advocate of his or her choice. so, you can appoint any Ld. advocate to conduct your case after taking a no objection from your earlier advocate.
