CAW cell not taking any action after filing FIR


11-Mar-2025 (In Divorce Law)
Husband abandoned after 14 years of marriage and filed ex parte divorce; I approached CAW cell for reconciliation/action. They have filed FIR 3 months ago but not even once set up any enquiry/investigation on husband nor his family. IO is Not providing any details of the FIR. IO is not cooperating. What remedy/rights I have?

If FIR has already been filed you can file an application requesting ATR and also file an application for monitoring of investigation before the concerned magistrate. In case if that is not helping you can file an application before the Hon'ble High Court under section 528 bnss which would be quite helpful

If the behaviour of your husband is intolerable towards you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. And if you wish to go legal then you can also file a petition under section 12 DV or section 125 CrPC and claim maintenance for yourself. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months.

Ma'am, you have a fit case where you must approach the magistrate of your concerned jurisdiction seeking day to day monitoring of the investigation and make the police station accountable for not making any progress in the case.

Dear ma’am, You can status report application before MM court and on 1st date IO called with the status of FIR. Your husband did not get the divorce without your reply even it is , then you can challenge it before HC. You can reach out to me if need further help. Best Regards Adv adarsh Kumar

the IO is duty bound to act fairly in the matter. if the io is not proceeding as per law, please escalate the complaint to the dcp and if no action is taken to the Commissioner of Police. still if no action is taken, file a complaint before the magistrate
