Case filed under grihahimsa act how we can file for divorce?

Hindu girl married Muslim boy. Marriage is took place as per Muslim custom. Marriage is not registered. Girl filed case against Grihahimsa act in 2015, since boy torturing her for money. He is not willing for divorce as per muslim law. They got one son staying with mother . Now both are staying separately in different places for the past two years, What is way to get divorce from the boy. Whether she has to wait till closure of Grihahimsa case. What are all the consequences if case is not for her.
Your is inntercaste marriage even if not registered you may have certain complications so it's better you can file for d divorce where we can say the person is not good ,bat characters ,irresponsible there after we can get divorced by Court.once you are divorce legally you can restart your life in fresh manner.
