Can a Wife File a Case Against Her Husband's Girlfriend in India?
04-Jul-2024 (In Divorce Law)
Criminally, consensual adultery is no longer an offence after the Supreme Court struck down IPC Section 497 in Joseph Shine v. Union of India [https://indiankanoon.org/doc/42184625/]; however the Bharatiya Nyaya Sanhita creates related crimes (for example enticing/taking away a married woman, BNS s.84 [https://sanhita.ai/en/bns/chapter-5-of-offences-against-woman/section-84-enticing-or-taking-away] and marrying again while a spouse is alive (bigamy), BNS s.82 [https://www.myjudix.com/post/section-82-bns-section-82-of-bharatiya-nyaya-sanhita-bigamy-bare-act]) that can attract prosecution if there is abduction, deception or an unlawful second marriage; adultery still remains a recognised ground for civil divorce under the Hindu Marriage Act s.13(1)(i) [https://indiankanoon.org/doc/1284729/]; and employment consequences are fact- and rule-specific: the Supreme Court has permitted disciplinary action by the armed forces [https://timesofindia.indiatimes.com/india/armed-forces-can-take-action-against-their-officers-for-adulterous-acts-sc/articleshow/97490372.cms] while civilian service tribunals have sometimes reinstated and sometimes upheld dismissals depending on service rules and nexus to duty (see Gujarat HC reinstatement [https://lawbeat.in/news-updates/most-immoral-no-misconduct-under-service-rules-gujarat-hc-reinstates-police-constable] and a judgment upholding dismissal [https://thelegalaffair.com/news/jharkhand-high-court-upholds-dismissal-of-police-constable-for-involvement-in-live-in-relationship-despite-being-married/]).
A wife can file a case against her husband and his girlfriend for cruelty or domestic violence, depending on the circumstances of the case.
- Cruelty: If the husband and his girlfriend are treating the wife with cruelty, such as physical or mental abuse, harassment, or emotional distress, the wife can file a case of cruelty under Section 498A of the Indian Penal Code (IPC). Cruelty is considered a criminal offense under this section.
- Domestic Violence: Under the Protection of Women from Domestic Violence Act, 2005, domestic violence is defined as any act or omission that harms or endangers the health, safety, or well-being of a woman. This includes physical, sexual, verbal, emotional, and economic abuse, as well as threats of such abuse. If the husband's extramarital affair causes mental or emotional harm to the wife, through verbal abuse, mental harassment, or neglecting her financial or emotional needs, the wife can file a domestic violence case against him.
If the wife can provide evidence that the husband's girlfriend is directly involved in any act of domestic violence against her or is aiding or abetting the husband in such acts, the wife can also name the girlfriend as a co-accused in the case.
The wife will need to provide sufficient evidence to support her case, such as eyewitness accounts, photographs, recordings, or any other relevant documents.
