20-Jan-2023 (In Divorce Law)
Hi , My wife has medical problem of anger attack and I want to treat her but because she has threated me and my family on several occasions that she will harm herself and put false case against us. I don't want divorce however if MOU could be signed with her parents and ourself that we will not be responsible for any such problems in future and if something goes wrong then we mutually agree to take divorce with no demand and retiring gold etc.without putting any obligations and blaim each other or family. Is it possible to have such agreement which could save my married life as well as I can be rest assured about my family safety. Regards

You can sign the MOU with your wife stating the contents mentioned in your query. The contents of MOU must be very specific, clear and elaborative in order to understand the pros and cons of the same to both of you.

Yes you can execute a MOU in that respect , advised to record the name of both Family members , record that the said MOU is a mutual adjustment of both family to solve the problem of anger attack, also intimate the police station about this fact, it will help you as evidence.

I suggest for your safety and as a precautionary step file a NC with nearest police station. This will take care of any suicidal attempts she makes to threaten you in future. MOU will not be a valid document in the eyes of law. You may make one for your mutual understanding, however it will not have any binding effect on either party. You take your wife to a proper doctor and help her combat anger attacks. Good luck.

Sir, In the above scenario it is best to file an NC to file on record the threats about false case .Further any MOU to be signed is advisable to be signed in the presence of neutral witnesses like any NGO. Though this MOU will not bind either side if a crime is alleged by her or her family after the Signing date put would be evidence for you of the past history of threats in the marriage.
