Can married woman live with unmarried man and plan a Kid with him befo

09-Feb-2023 (In Divorce Law)
Married woman from Mumbai stays separately from past few years. Husband is NRI and lives abroad. Now she wants divorce due to compatibility issues and wants to start new life with unmarried man. Not seeking alimony. However, she hasn't discussed divorce with her husband due to anger issues of the husband and societal damages that husband will cause. She will file for divorce immediately once husband says for it. My queries are– 1. Can she start a live-in relationship with another guy if her husband does not gives her divorce? 2. Can her husband take any legal actions against her and the guy if he comes to know about her live-in relation? 3. Can she plan for a kid with another guy in legal way pending divorce? If yes, what are the legal formalities / procedures? The question though seems inappropriate but it is purely considering the anger /ego issues of husband who would purposely delay the divorce, tarnish family name in society just for asking divorce.

1. she can't without divorce legally 2. yes he can sue the paramour for adultery 3. no 4. in my opinion, file for a divorce ask maintenance and file multiple cases, issues of getting it amicably sorted are better, if u file multiple litigation.

Hindu marriage is “a religious sacrament in which a man and a woman are bound in a permanent relationship for the physical, social and spiritual need of dharma, procreation and sexual pleasure.” ... It is a religious and holy union of the bride and groom which is necessary to be performed by religious ceremonies and rite. she has to take divorce first then she can get married
