Can I Have a Live-in Relationship Without Divorce?

17-Jul-2024 (In Divorce Law)
Hello Sir, I got married 8 years ago, but my wife left me 2 years ago after I lost my job. She is a government employee, earning well, and living happily. However, she does not respect me or my family and is not interested in returning.

I feel like I am losing happiness in my life. My wife is unwilling to give me a divorce and also does not want to stay with me. This situation is affecting my mental health, and at times, I even have suicidal thoughts. I have a female friend who is unmarried and has no family or support. If we decide to live together to share expenses, would it be considered an offense or a crime? Can I live in a relationship without divorce?

Can You Have a Live-in Relationship Without Divorce in India?

In India, a married person cannot legally enter a live-in relationship with another individual without first getting a divorce, as this may be treated as adultery or even bigamy, depending on the circumstances. While the Supreme Court has recognized live-in relationships, such protection generally applies to unmarried consenting adults.

Legal Rights & Considerations

It is important to note that legal rights and obligations in a live-in relationship are different from those in a marriage:

  • There are no automatic rights for property, inheritance, or financial support as in marriage.
  • Rights in a live-in relationship depend on mutual agreements, personal understanding, and relevant laws such as the Protection of Women from Domestic Violence Act, 2005.

Legal & Social Consequences

  • If a married person enters a live-in relationship, it may be considered a breach of marital obligations. This can be a valid ground for divorce and may make the adulterous spouse ineligible for maintenance.
  • While live-in relationships are legally recognized, they may still be viewed as morally or socially unacceptable by some communities.
  • If a person marries their live-in partner while still legally married, it can be considered bigamy, which is a criminal offense under Section 494 of the Indian Penal Code (IPC). Their legal spouse may initiate criminal proceedings against them.

Dear Client, As per Hindu law, a married person cannot have an extra-marital relationship with anyone other than their spouse. If you wish to live with your girlfriend, you must first file for divorce. After the legal process, the court will grant you a divorce if your case is valid.

Since your wife has been living separately for nearly 2 years, this can be a valid ground for divorce. Even if she refuses to give a divorce, you can still file a petition in court with the help of an expert divorce lawyer.

Without obtaining a legal divorce, you cannot start a matrimonial relationship with another woman, as it may be considered an offense. Your wife may file a criminal case against you for bigamy under Indian law. To avoid legal complications, it is strongly advised that you first file a divorce petition in a competent court and follow the legal process.

First, try to resolve the issues between you and your wife. If you're unable to reach an amicable settlement, you can file for divorce on the grounds of lack of a marital relationship.

Secondly, there is no legal prohibition against living with your friend if you're both consenting adults. Don't let depression take over— seek help and remember that you can also support your friend, especially since she doesn't have family support.

Many factors come into play, and the final decision will depend on your specific situation. Stay strong and consider speaking to a counselor or legal expert for guidance.
