Can I hack my spouse's account if contested divorce is in process

Should hacking of spouse email and forwarding emails from it, during ongoing contested Divorce, attract charges under IPC sections 419 & 420,when sections of Information Technology Act have already been charged ? If not,what arguments and judgements can be provided to court to remove the charges under sections of IPC especially IPC 420?

Look baking of personal Information is illegal but however if you have information which supports your case the court would not ask the source from which you have got.Further more you have to prove the digital information in light of IT Act and Indian Evidence Act.

the provision of section 419 & 420 IPC will be attracted in the above mention case as hacking a spouse's email account is per se a form of cheating and is punishable under IPC. however, you provide me with proper details of the case so that i can help you better.

See, hacking is termed as malicious activity under various laws.
Hacking/cracking anyone's account without his/her consent is an offence and same attracts penalary provisions.
It is also a breach of privacy and intrusion of personal space.
