Can I get a divorce from my husband who is in jail?

Hiii im... I got married May 7th 2015..ve stayed til sept 2015..then he gone to job in saudi.. Tilnw he didnt cme.. Nw he s in jail due to sme job issue.. I dnt lik to stay wit him n my parents forcing me to live wit him.. Can i get divorce frm him...?
The gravity of offence is important. If he is jail due to murder while he was in job, then it is hard to get divorce. If the person is at jail at Dubai then the spouse have to move through embassy. Ok.
