Can I file for Divorce from Male side

22-Feb-2026 (In Divorce Law)
I married in January 2022. Since last September, my wife has been living separately. The relationship has deteriorated mainly due to financial trust issues. She took money from my family without prior discussion and had also not disclosed certain past financial liabilities. We have bank transaction records as proof, but there are no loan documents or WhatsApp/chat conversations available. Can I initiate divorce proceedings at this stage?

Yes, you can initiate divorce proceedings. If governed by the Hindu Marriage Act, you may file on the ground of mental cruelty, as financial concealment and breach of trust can amount to cruelty. Bank transaction records are valid evidence; absence of chats or loan documents is not fatal. If both parties agree, mutual consent divorce is also an option. Consult a local family lawyer before filing.

Yes, you may initiate divorce proceedings at this stage. In fact, it is advisable to file the divorce petition at the earliest, before your wife initiates any further proceedings against you. For drafting and filing the divorce petition, and for any further legal assistance, you may contact me.

You can file for divorce on grounds of 'Mental Cruelty' due to financial breach of trust. Use bank records as circumstantial evidence of unauthorized transfers. Since you have been living separately and the trust has collapsed, the court can view these irregularities as a valid basis for the breakdown of marriage.
