Can i change my decision after filing for mutual divorce.

we have filed a mutual divorce in barasat court in w.b.six nonths ago,but now i have changed my mind due to my daughter,that I will not live without my wife,bt she is not continuing the relation,what should i do?

yes you can very well do it, you have to go and appear before the court alongwith your lawyer and along with your wife and plead that you want to stay with your wife, alongwith the same you must keep the restitution of conjugal rights draft ready with you so that you can file instantly plus then and there inform the local police station of your change in decision and moreso, your wife may get instigated and file a 125 or DV case against you.

It is good to know that you have changed your mind. Yes, even if you have filed for mutual divorce you can plead before the court that you do not want to get the divorce. First, you should negotiate with your wife with reason and try to convince her that it will be the right decision to take for your child and you both will work on your marriage. But if that does not work you can file for restitution of conjugal rights.

On the next day of hearing submit before the court about your opinion of continuing your marital life and withdraw the petition. Discuss with your wife also.
