Can i ask for maintenance/alimony from husband if i'm earning

Hi. I am 30yrs old, married 6 yrs With 3.4 yrs old son. My husband and I are living separate due to some personal issues for over a year and he is paying half tuition fees of my son. Tat is all he has given. He earns 7lakh per annum. I earn more than him. So if we go for mutual how much can I claim as per law. Also during these years he had been unemployed for over a year and currently he is unemployed too since 2 months.

If you wish to file for mutual divorce then your claim amount depends on mutual decision. whereas if you wish to file a contesting divorce petition then your claim amount depends solely on the annual income and other source of income of your husband.

Since you are Gainfully Employed you cannot claim any alimony/maintenance from your husband, since he is unemployed.

However, you can claim share on the Immovable Property if he owns in his name and also maintenance for your son.
