Can I and my daughter stay separately from my husband without divorce

If my trust is broken by my husband then can I deny the marital duties /rights and can law allow me to stay separate with my daughter without taking official divorce
Dear client u can live separately with daughter without taking divorce. But husband can disturb u by filing litigation like restitution of conjugal rights and child custody petition. Law doesn't prohibit you to stay separate from your husband. So you can in any reasonable case stay separate from your husband even if you don't go for divorce. You have got a reasonable cause for staying separate. With respect to your daughter if she is major the daughter's wish is taken into consideration.
