Can husband take guardianship of incapacitated wife

is it possible husband to take up the guardianship of her wife when she is an incapacitated adult who is on drugs and is threat to society and for her self.. when divorced has been filled by the wife.. if yes the how?

On what grounds have the DIvorce been filed by your wife. If Divorce is filed then how can you say that she is in an incapacitated state. Incapacitated state means that she is not at all in a position to take any decisions.

Unless and until the marriage is dissolved through the orders of the court,the marital relationship exists between husband and wife. In the case in hand you are free to take up the guardianship of your wife as you are at present her person responsible for all of her acts.
