Can file dowry case against my inlaws to recover my belongings

22-Jan-2023 (In Divorce Law)

Hi, I am staying separate with my kid from my husband from last 10 months due to things not working between us. I am still not able to make up my mind for divorce but I need to recover my belongings( my car worth Rs. 7 lakhs & approx. 200 gms gold ornaments and few silver items) from him and his family which they are not ready to return. They claim I have taken everything along when I left their home. which is not true. I just want to understand can I first recover my belongings by putting a dowry and harassment case and then see If I want to divorce him. Request you expert advice.

Where is ur car now ? Is it on ur name and registered ? U may file complaint in the Police Station by giving Notice to them if they refuse to give it and is with them on the charge of theft . Secondly u make up ur mind to file 498 A of IPC against ur in laws for dowry harassement. There is further alternative of filing Domestic Violence Act if u have not prepared ur mind . U cannot eat the cake and keep the same.

yes obviously you can take your belongings and also file a suit against them for harassment, you can also claim monthly expenses and file a divorce case. if you do not wish to take a divorce, you can any time withdraw your case. Divorce case will bring them on track.
