Can dowry case we filed after 9 years of marriage?

My elder brother wife has charged us my father mother husband and me under dowry act and attempt of rape. Matter was at mahila thana. My brother marriage took place in 1 mar 2006.I want to ask does dowry act can be filed after 9 years of marriage nad without any doctory report or eyewitness attempt of rape can be charged.She also filed an fir.All complaint was done in june 2015, since then many level of councelling hel ad mahila thana then at court chamber but all was failed as she was not ready.And she is living wih us only in other portion.My brothe has two children of 6 yeras.pls help
