Can a Deed of Compromise be Cancelled if obtained through unfair means

29-Nov-2023 (In Divorce Law)
Respected sir, I have entered into a Deed of Compromise with my husband before the Notary Public, but at the time of signing of the Deed of Compromise my husband alongwith his lawyer mentioned some of the clauses which are not in favour of me as well as after the execution of the Deed of Compromise, my DV case has been disposed of. Kindly let me know if there is any possible means to Cancel/ revoke the deed of Compromise which was obtained by my husband using pressure upon me.

Yes you can always say that the said compromise deed was signed by you under undue influence and was done fraudulently. And as far as the DV case is concerned it can't be disposed of as it requires your testimony to withdraw the same. But still you have got many other options like 125 CrPC or divorce.

If you have not taken any thing in lieu of that compromise deed then u Hv to immediately issue notice to your husband via your advocate but if u have taken money etc then it’s tough but u only have one option to file suit for cancellation of this deed Plz b in touch
