Asking maintance and do not want to stay with me.

I wife do not want to stay with me and want to stay at her parents home. And she is asking for monthly some amount as a maintance. We r not divorced. Will I am liable to pay any amount if she dont stay with me.I Told her if u dont stay with me and leaving me in this situation(My health condition is not good) why I should pay u.

Hello reader Yes, a husband can still be legally liable to pay maintenance even if the wife is not living with him, unless he proves that she is living separately without sufficient and reasonable cause.

you can file application in court under hindu marriage act 1955 section 9, where you request from court your health possition is not good and your wife is not living with you . court will release the notice to your wife...

you have to file restitution of conjugal rights petition in the court and it will be a strong defence if in future your wife files a maintenance case against you. you can take this as a defence and tell the court athat you are ready to maintain relationship with your wife.
