Filing mutual consent divorce requires presence of both the spouses. If any of the spouse does not come before court then mutual divorce cannot happen. Now to obtain divorce you have to file another petition for divorce

Dear queriest if he is not attending the case of 498A then the court may issue summons against him to be present before the court, and also may pass order for NBW, also as you said you filed for mutual divorce, in which while filing he must be present before the court unless and until both parties are present you cannot file mutual divorce. for more information about the same kindly call me .

Get a non bailable warrant issued against him by making application in the court through your current advocate. He will have to come to court and appear for cancellation of non bailable warrant or else he'll get arrested. If he wants to dissolve the marriage, he will come for mutual Divorce case. Or else he won't come. Try talking to him for ending the marriage by mutually dissolving it and ask him to appear before court for it.
