Allenation of affection Against Mistress

09-Oct-2025 (In Divorce Law)
It’s been 2.5 years since my husband married his mistress without getting a divorce. A divorce case and a criminal case are still pending in court. Can I file an Alienation of Affection case against the mistress? If I claim compensation between ₹10 lakh and ₹50 lakh, how much will the court fee be in this case? Can anyone explain that?

Indian courts have allowed such cases under tort law, which allows you to sue for emotional and mental distress caused by a third party interfering in your marriage. The Court fee will be decided on the basis of your state

yes you can file a case recently there is a judgement to the effect but you need to understand how the court functions and moreso what is the status of your cases if we can sit face to face we can jointly come to a constructive solution

since there is divorce case pending, the entire matter should be brought to the notice of the Court through evidence. The concept of alienation of affection is yet to develop in India. however there are other ways which can be applied in your case.
