If your wife has filed a complaint against you in the court on the basis of false facts then you can obtain divorce by presenting a divorce petition in the court under Section 13(1) of the Hindu Marriage Act on the grounds of mental cruelty. yes, you can file a divorce petition in family court,You can file a divorce petition in the Hon'ble Family Court on the grounds of adultery or cruelty. For how many days have you been living away from your wife?
