15-Jun-2023 (In Divorce Law)
My daughters Mutual Divorce case was disposed off by Court, because her hot tempered husband declined to give her divorce at the last minute in court. Please advice what to do. Can she initially ask for maintainance , she is now living at parental house and is in service.

If your daughter is getting unnecessary harassment from her husband and in-laws then she can anytime send a complaint regarding her grievances in writing to the police station according to your jurisdiction and register a FIR under section 498a IPC. She can also file a complaint under section 12 DV act before the court or you can also file it under section 125 CrPC and claim your monthly maintenance. I would recommend you to go for getting an FIR lodged against your son in law and his family members for demand of dowry and domestic violence if it applies to your case. Secondly, the maintenance depends on various aspects. Just because she is in service doesn't mean she is not entitled for maintenance. There are supreme court judgements in that regard. For more details you may consult me.

if husband proves she is not living separately with valid reasons then no. as she is working so that is also against her plus I need info on husband financial status too. she can file for contested divorce too.
