Suspected of Smuggling of gold worth rs 3100000

If a person is under trial for smuggling of gold worth rs 3100000 then is his offence a bailable offence?? If yes how and when to apply for bail and in how many days the bail will be granted ??
same day bail as you are not evading duty to the tune of rs. 50 lacs secondly gold does not comes under the ambit of prohibited goods. you can also claim your gold after paying relevant duty which is thirty six and a half percent.
