07-Mar-2026 (In Criminal Law)
Complainant has filed two false private complaints. One matter is 10 years old, second matter is 8 years old. In both cases, complainant first name has spelling error. So many years go by, but complainant not update his name on court record. Whose duty to ensure correct name on record -- Court or Complainant? What possible reason for Court to ignore or Complainant to ignore?

In a private complaint, it is the complainant’s duty to give correct details like name and address when filing the complaint under Section 200 of the Code of Criminal Procedure. The court mainly records the details provided and usually does not correct minor spelling errors unless someone raises an objection. A spelling mistake may remain for years because of negligence, clerical error, different spelling usage, or because no one objected to it. Courts often ignore minor spelling mistakes if the person’s identity is clear and it does not affect the case.

In a private criminal complaint, the responsibility to provide correct personal details, including the correct spelling of the complainant’s name, lies with the complainant. The complaint is filed by the complainant under the procedure of the Code of Criminal Procedure, 1973 (such as Section 200), and the court generally records the particulars as stated in the complaint. The court’s duty is mainly to examine the complaint and take cognizance, not to verify or correct the complainant’s personal details unless the complainant files an application for correction. Minor spelling mistakes in a name are often ignored by courts if the identity of the complainant is otherwise clear, a principle recognized in various judgments of the Supreme Court of India. this is a minute mistake which can be usually overlooked or not taken into consideration because the court has a bigger problem to deal with for example to give justice to the complainant, you have verification and identification of the complainant is done, search minded mistakes are always negligible in court, sure it should be rectified but it will be done in the due course of time, if it is not affecting the nature of the case or if it is not affecting the evidence of the case.
