When does Defendant have absolute right to be heard

In private complaint, plaintiff can get judge do police investigation. In investigation, the defendant has no right for argument before judge or police to quash FIR or quash investigation. After judge receive police report, the defendant is still not an accused because no charge has been framed. If no summons issued to defendant, accused has no right to be heard. My advocate tell me this in false complaint case accused should not interfere. I seek second opinion whether my advocate is correct.

Dear sir I disagree with the advice given by your counsel to you as there are judgements in this regard which are contrary to what your advocate has told you. You have a right to be heard with limited locus standi till cognisance is taken.
