What to do if the car is used for illegal purpose after it's been sold

21-Jun-2023 (In Criminal Law)
I sold my car 2 years ago and gave all documents to the person to transfer the vehicle under his name and did not keep any proof. He did not transfer vehicle and after some time sold to someone else. Now I have got a call from Bihar police that the vehicle has been caught transporting Alcohol and is still registered to my name. The driver is absconding. They said that the FIR is filed under owner name which is me and case will be against me. Please suggest what to do now.

Not keeping a record of the vehicle, that's very bad on your part, the owner is 100% responsible if he cannot prove he had sold the vehicle to third person.

you have to get in touch with the person to whom you sold the vehicle. Make sure the transfer papers are signed back dated.

Since the case has been filed in your name, you have fight the suit. But you can save yourself by showing that the said act wasn't done on your behalf. Also bring witnesses that know you have sold the car to someone else. It will depend on how you fight the case.
