What should i proceed with in this criminal case

22-Aug-2025 (In Criminal Law)
Police Performed a raid at my shop and found one packet of ghutka and was informed to pay rs500 when they called to meet us.They didn't called us back for weeks but now they called and told us to come meet tomorrow and told us they would like you to summon in court (which i think is just a way to make us pay more). Should i go and pay a visit to them where they might ask for more money or i do have a political connection in the family(MLA) whom i can call what should i do?

Contact A Lawyer, if you are insisted to visit the Police Station, let an Advocate accompany you. If you visit alone, ask them politely which laws/regulations have you broken, as you are unaware. I will suggest not to visit unless and until you have a notice by the Police, which states the reasons for them to call you for the questioning. (Sec 41 A CrPC) Without any complaint/FIR you can't be summoned by the Courts in your case. And whenever you are summoned by the Court, it will be by that Court and not through any Police Officer/Police station. All The Best.

Even kne packet of Ghutka can land you in trouble if police wants to book you. The way you've described your situation, it does not show that Police has formally filed any FIR or any case has been registered against you. Now that they are calling you it may be for more money as you've rightly pointed. If they had really filed a case against you, then you would have received a writren Notice or summons from Police. They won't call you by phone for court summons. You can visit them, and politely ask them the reason, listen to them ...ask the if they have registered the case or not, if they have take the copy and tell the you'll take legal course. This will block any more extortion calls from them. If they can't show you any documents, then nothing to worry about. Speak to the officer and get the matter sorted once and for all (you can involve 3rd person to sort it out amicably) Nothing to worry about.

Do not pay money illegally. Ask for a copy of the seizure memo or FIR. If they are threatening summons, wait to see an actual legal notice from court. If any FIR is filed, you can apply for bail and contest the case in court. Usually, such cases attract fine or minor penalty if it’s a small quantity. Using your MLA relative might give temporary relief, but it is better to keep the matter strictly legal. Political pressure sometimes backfires if the case goes on record.
