The Bombay High Court has not yet issued a ruling specifically interpreting the proviso to Section 223(1) of the Bharatiya Nyaya Sanhita (BNS), 2023, which mandates that a Magistrate must provide the accused an opportunity to be heard before taking cognizance of an offence. However, other High Courts have addressed this provision, offering insights into its application.
