Greetings, Do seek a detailed legal Consultation from an Advocate having expertise in Property Cases. Do connect and brief the lawyer to enable him to advise you on this ongoing issue as to how to proceed further. Do connect with better particulars and details of the Complaint filed

To handle a false police complaint from a relative, gather evidence (like call records, CCTV footage, and witness statements) to prove your innocence. Cooperate with the police investigation, file a petition in the High Court to quash the FIR if any , and consider filing a counter-complaint for defamation or other offenses against the relative. If the false complaint is malicious, you can also seek compensation or take other legal actions against the complainant and potentially the police for their misconduct. Rest we can discuss over call

Nothing will happen. Releasing of summons will not stop you or put stay on your passport. Recent judgment of supreme court clarifes it and your right to travel abroad will not get infringed due to such issuance. If so it is a violation of your right to life which includes right to travel abroad also.

Collect documents proving your share in property. Reply to any police notice through an advocate. If summons come, engage a lawyer and attend (to avoid ex parte orders). For passport, immediately write to the RPO that the objection is motivated by property dispute. Attach court judgments if required. If harassment continues, you may also file a complaint under Sections 182/211 IPC for false complaint, or defamation.

From your query it appears that your cousin has filed a false complaint due to the property dispute. Please note, police clearance or objection in such matters cannot be raised merely on the basis of property dispute. If any false criminal case is filed, you can apply for anticipatory bail and contest the case on merits. For property-related issues, you should file a civil suit for partition or declaration to protect your rights. If summons are issued, you must appear before the court through your advocate, otherwise it may go against you. You may also file a complaint under Section 182/211 IPC for false complaint, but only after proving the case is baseless. Immediate step is to secure your defence in any criminal proceedings and parallelly pursue your civil rights in property.
