If a rape FIR has been registered, immediately obtain a copy of the FIR, cooperate with the investigation, and preserve all chats, call recordings, emails, photographs, travel records, and other evidence showing the nature of the relationship. If the allegations are false, you may apply for anticipatory bail or regular bail as applicable and contest the case on merits. After collecting evidence, you may also consider appropriate legal action for false allegations, defamation, or malicious prosecution, subject to the outcome of the criminal proceedings. Consult a local criminal lawyer without delay.

Since emails are often ignored, send a formal written complaint detailing the mob assault to the Superintendent of Police via Registered Post. If they still fail to register an FIR, approach the jurisdictional Magistrate under the BNSS to direct the police to investigate the matter.

If a criminal complaint/FIR has been lodged against you, do not ignore it. Immediately obtain a copy of the FIR/complaint and consult a local criminal lawyer. If you apprehend arrest, you may consider applying for anticipatory bail before the competent court. Preserve all evidence relating to the relationship, including chats, emails, call records, photographs, travel records, and any other communications that may support your defence. If the relationship was consensual, such material may be relevant during investigation and trial. Cooperate with the investigation and respond to notices issued by the police as advised by your advocate. The merits of the case will depend upon the specific allegations, available evidence, and surrounding circumstances. A detailed review of the FIR and related documents is necessary before advising on further legal remedies.

If a false rape case has been filed against you, do not panic and do not contact the complainant directly. First, obtain a copy of the FIR/complaint and have the allegations examined carefully. The facts, messages, call records, chats, photographs, travel records, and conduct of both parties are important in such matters. If the relationship was consensual and the allegations are false or exaggerated, appropriate legal remedies such as anticipatory bail, quashing proceedings (in suitable cases), and presenting exculpatory evidence may be available. Every case depends on its specific facts, so a detailed review of the FIR and supporting documents is necessary before advising the best legal strategy. Please share the FIR and relevant documents for proper legal guidance.
