Walking on the road drunk not creating any nuisance police fined me

If iam drink alcohol. Iam not making any public nuisance .iam walking on the road . if police are there on the way . they told me you are drunken so you have to pay fine . if iam not making any problem , they can take action against me?..

Dear,
Unfortunately there is such a provision still exists in our IPC and connected Criminal Laws that ''Police can charge some one who is incapable to save him self". So, if at all one man who is not creating nuisance to others still Police can invoke this provision in their favour, especially one who wandering in street in drunken state/stage. However, some one should challenge such type of stringent provisions in the Court of Law.

Usually the police is charging section 118 (a) of KP Act .

118. Penalty for causing grave violation of public order or danger.-- Any person who,- (a) is found in a public place, in an intoxicated manner or rioting condition or incapable of looking after himself shall, on conviction be punishable with imprisonment for a term which may extend to three years or with fine not exceeding ten thousand rupees or with both."
