Two issues, firstly what sort of criminal case filled against you and secondly, the person who is out of India, does he has some relative in whose favor he can send power of attorney to represent him in all sort of settlement processes required for the compromise and quashing or dismissal of the criminal case.
As far your passport issue, there if you have not be held guilty by the court for any criminal charge than there won't be any issue for rejection of your application for passport. You may be issued passport for short limited period if criminal prosecution is going on in the court. If no prosecution going on, you get proper passport for provided period as per rules.

you have to share the details of the case like sections, under which you have been charged, status of the case, whether evidence of the complainant and injured has been recorded or not. If it still required to be recorded then the witnesses can turn hostile and that can be done in the absence of the co-accused. however, if the offenses are compoundable then the presence of the co-accused is required.
