Used Car Turns into Nightmare After Seller Reveals Hidden Loan

22-Oct-2025 (In Criminal Law)
I purchased a used car in March from a person. He said the car was his but registered under his cousin brother due to loan issues. All payments were made via bank transfer. After full payment, I brought the car home, but the RC transfer kept getting delayed. He later revealed another loan was pending, preventing the bank from issuing a NOC. Today, he admitted the car actually belongs to his friend—who is now unreachable—and the bank has issued a legal notice. What should I do now to recover money?

Sorry to hear about the situation with your used car purchase. Given the complexity, I'll break down the steps you can take to recover your money. - *Gather all documents*: Collect the bank transfer receipts, any communication with the seller, and other relevant paperwork. - *File a police complaint*: Report the incident to the police, providing them with all the evidence. This will help create a paper trail and may aid in recovering your money. - *Contact the bank*: Reach out to the bank that issued the legal notice and inquire about the loan status. They may be able to provide guidance or assistance. - *Seek legal advice*: Consult with a lawyer specializing in consumer protection or property law. They can help you navigate the situation and explore options for recovering your money. - *Check for deemed ownership*: Since you purchased the car, you might be protected under deemed ownership rules, which can shield you from liabilities. Verify this with your lawyer ¹. Some key points to discuss with your lawyer: - *Misrepresentation*: The seller misrepresented the car's ownership, which is a serious offense. - *Unfair trade practices*: The seller's actions may constitute unfair trade practices, entitling you to compensation. in - *Recovery options*: Explore possibilities for recovering your money, such as filing a case against the seller or seeking compensation from the bank. Remember to stay calm and methodical in your approach. With the right guidance, you can work towards resolving this issue.
